Alia vs Uba: Tension in Benue as Tribunal gives verdict on guber election

Benue State is on edge as the governorship elections tribunal is set to deliver its judgment on the 2023 governorship elections today. The three-member panel led by Justice Ibrahim Karaye had adjourned the matter for judgment after final addresses by counsels.

Supporters of the two main political parties, the All Progressives Congress (APC) and the opposition Peoples Democratic Party (PDP), are tense. Members of both parties are worried about the outcome of the judgment.

The PDP candidate, Titus Uba, and the party filed a petition challenging the victory of Governor Hyacinth Alia of the APC in the March poll. They asked the tribunal to nullify the election, claiming that the candidates did not comply with the electoral law and submitted false documents to INEC.

The PDP camp is hopeful that the tribunal will rule in their favor, citing the strong evidence of wrongdoing they have presented against the APC candidates. Most supporters of Uba are upbeat and confident of winning the case, while many supporters of Gov Alia are optimistic that APC will have a favorable judgment.

Many members of the opposition PDP have arrived in the state capital hoping their party will win its case at the tribunal, while others are skeptical because of the power and influence of the ruling party. However, many APC stalwarts in the State believe their party will win the case as the evidence tendered by their opponent is weak.

The security agencies in the state have restricted vehicular traffic around the court where the judgment will be delivered. A security source indicated that arrangements will be expanded to check any breakdown of law and order.

In a statement issued by its Publicity Secretary, Barrister Valentine Onojeghuo, the APC conveyed its confidence that the mandate bestowed upon it by the people of the state, who believe in the party’s commendable programs and the capability of its candidate, Sen. Ovie Omo-Agege, will be reinstated.

The All Progressives Congress (APC) has issued a 48-hour ultimatum to Haruna Dederi, the Kano State Attorney General, demanding a retraction or presentation of evidence regarding his claim that the Appeal Court justices involved in the Kano governorship election judgment were compromised. The party, through its Kano State chairman, Hon. Abdullahi Abbas, has urged Dederi to identify individuals who allegedly interfered in the judgment, warning of potential legal consequences.

Abbas conveyed this ultimatum in a petition dated November 23, addressed to Dederi and titled “Injurious, malicious and false statement against the judiciary and our party on a live television program and a voice note going round in the social media: Demand for retraction.” The petition referred to Dederi’s appearance on the Channels Television breakfast show on November 23, during which he accused the Judges of the Kano State Governorship Election Petition Tribunal and the Court of Appeal justices of corruption. Specifically, Dederi claimed that the Tribunal’s decision to deliver judgment via Zoom was due to external interference.

In the petition, Abbas insisted that Dederi must reveal the names of those allegedly involved in influencing the courts’ judgments within the given 48-hour timeframe. Failure to comply would result in legal action, including filing a petition with the Legal Practitioners Disciplinary Committee and pursuing a defamation lawsuit against Dederi in court. Abbas emphasized that such actions were necessary to protect his and the party’s reputation from the damage caused by Dederi’s statements, unless a public apology and retraction were issued.
